PANEQUE (hereinafter, the «Foundation») makes this legal notice available to users, in order to comply with Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE), as well as with Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users.

This website is intended to facilitate the making of donations and family aid to Cuba, as well as to provide information about the services and activities of the Foundation.
The user undertakes to make correct and lawful use of the website and the services offered, refraining from using them for unlawful purposes or for purposes contrary to the law, morality, public order, or that may harm the rights of third parties or of the Foundation itself.
All contents of the website (texts, images, logos, design, etc.) are the property of the Foundation or of its legitimate owners, and their reproduction, distribution or modification without express authorization is prohibited.
In accordance with the General Data Protection Regulation (GDPR) and Organic Law 3/2018 on Personal Data Protection and guarantee of digital rights, we inform you that the personal data provided will be processed by the Foundation for the purpose of managing donations and providing the requested services. You may exercise your rights of access, rectification, erasure, objection, restriction and portability by contacting info@robertapaneque.org.
The user has the right to request the cancellation of their donation and the refund of the corresponding amounts within 24 hours of making it, provided that the money has not yet been delivered to the beneficiary in Cuba.
In the event that the money cannot be delivered to the beneficiary due to errors in the data provided by the sender, the funds will be refunded to the sender, deducting the bank and currency exchange expenses incurred.
If the error is attributable to the Foundation, the full amount of the funds will be refunded, including the transaction charges. The refund process may take between three and four weeks due to verification and bank cancellation procedures.

The Foundation sometimes ships handicraft products and other items related to our artists, as well as documents for legal procedures. We use Correos de España as the shipping company for the management of deliveries.
Delivery times in Spain are generally 2 to 5 business days. Shipping costs to the customer are already included in the price we assign to the products or documents they request.
For international shipments to Cuba with boxes containing documents, photovoltaic equipment, medicines, food and essential items, we have used for many years the services of the parcel agency ODC Envíos, located at calle Santa Elena, 15 Madrid, Spain.
In the case of money donations to Cuba, these are managed through Cuban family money aid companies and international bank transfers, with an estimated delivery time to the beneficiary of 1 to 5 business days once the payment is confirmed.
These conditions are governed by Spanish law. For any dispute arising from the use of the website, the parties submit to the courts and tribunals of the city of Madrid.
